Terms of Use

The Site provides information about Jaki’s software, services, network, and publicly purchasable products. A product purchase is governed by these terms and any product-specific terms presented before payment.

The Aircraft Privacy Report is also governed by the Aircraft Privacy Report Terms. If those product terms conflict with these general terms, the product terms control for that purchase.

Client platform access, consulting engagements, remediation, filings, and other services may require a separate agreement or statement of work.

Prices, scope, and delivery timing are shown before checkout. Payments are processed by Stripe or another disclosed payment provider. Jaki does not receive or store full payment-card numbers.

You are responsible for providing accurate purchaser, delivery, and product information. Taxes, if applicable, may be added at checkout. Delivery and refund rights for the Aircraft Privacy Report are described in our Refund and Fulfillment Policy.

You may submit information only when you have the legal right and authority to do so. You must not impersonate another person, misstate your relationship to an aircraft or organization, or submit altered, misleading, unlawfully obtained, or fraudulent documentation.

You are responsible for reviewing the product scope, limitations, and delivery terms before purchase and for keeping delivery links and reports secure.

You may use the Site and purchased reports only for lawful, legitimate internal purposes. You may not use them to stalk, harass, threaten, surveil, discriminate against, or facilitate harm to any person; interfere with aircraft operations; evade law; or violate privacy, intellectual-property, contractual, or other rights.

You may not misuse the Site, bypass access controls, test its security without permission, scrape or harvest Site content at scale, enumerate aircraft or purchasers, resell reports, or commercially exploit Jaki content without written permission.

Site content and reports are informational. They are not legal, financial, tax, insurance, investment, aviation-safety, operational-security, or other professional advice and do not create an advisory, fiduciary, attorney-client, agency, or similar relationship.

You may not use an Aircraft Privacy Report as a consumer report or for credit, employment, housing, insurance underwriting, or another eligibility or adverse-action decision.

The Site and reports may identify or link to FAA programs, public records, search results, data providers, and third-party websites. Third-party information may change, become unavailable, contain errors, or be subject to separate terms. Links do not constitute endorsement, and Jaki does not control the linked content.

The Site, report format, methodology, text, design, images, graphics, and other Jaki content are owned by Jaki or its licensors and protected by intellectual-property laws. You may retain a purchased report for your authorized internal use but may not reproduce, distribute, publish, sell, or create a commercial derivative without permission, except as permitted by law.

Jaki™ and the Jaki mark are trademarks of Jaki Group, Inc. Other names and marks belong to their respective owners.

We may reject, hold, cancel, or refund a request when we cannot reasonably validate it, suspect unauthorized or abusive use, identify inaccurate information, must comply with law, or cannot safely fulfill the purchase.

Automated processing of an Aircraft Privacy Report begins after successful payment. A purchaser therefore may not cancel merely because processing has begun or the report has been completed. The cancellation and refund rights stated in the applicable product terms and Refund and Fulfillment Policy still apply.

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available.” Jaki does not warrant uninterrupted availability or that public records, third-party sources, or search results are complete, current, or error-free.

To the fullest extent permitted by law, Jaki is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the Site, a report, third-party content, or inability to access them. Nothing in these terms limits rights or liability that cannot lawfully be limited.

To the fullest extent permitted by law, Jaki’s aggregate liability arising from a purchased online product will not exceed the amount paid for that product. For a claim arising solely from use of the Site without a purchase, Jaki’s aggregate liability will not exceed $100. These limitations do not apply to liability that cannot lawfully be limited.

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these terms, the Site, or a publicly purchased product must be brought in the state or federal courts located in Miami-Dade County, Florida, and each party consents to their jurisdiction and venue, except where applicable law requires otherwise.

If a provision of these terms is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these terms or a purchased report without Jaki’s written consent. Jaki may assign these terms in connection with a merger, financing, reorganization, sale of assets, or operation of the applicable business.

These terms, the Privacy Notice, the applicable product terms, and the Refund and Fulfillment Policy form the entire agreement governing a publicly purchased product, unless Jaki and the purchaser agree otherwise in writing.

Our handling of personal information is described in the Privacy Notice. By completing an electronic acceptance or purchase, you consent to transact electronically and receive records at the email address you provide.

We may update these terms prospectively. The version accepted for a completed purchase will govern that purchase unless a change is required by law or you agree otherwise.
